Ombudsman for Children’s Office responds to Supreme Court’s Surrogacy Judgment

The Ombudsman for Children’s Office (OCO) stated that today’s Supreme Court judgment in the case of MR & Anor – V – An t-Ard Chláraitheoir & Ors is very significant.

Earlier this year, the Ombudsman for Children recommended strongly that the Government legislate to provide clarity regarding the legal relationships of children born through surrogacy. It is manifestly contrary to children’s best interests to allow the current legislative gap to persist.

The Ombudsman for Children’s Office hopes that today’s judgment will provide a fresh impetus to the proposed legislation and that the Oireachtas will consider the matter as soon as possible. Further details of the OCO’s position on the legal regulation of surrogacy – both domestic and international – can be found in its advice on the General Scheme of the Children and Family Relationships Bill.
